Case Study Analysis
The case under consideration concerns crimes committed against children. There are images that have been taken by Brian’s friend and uploaded in the internet reaching a global audience. Nonetheless, the actions of Brian and his find must be evaluated under legal lenses to determine whether there is criminal substance within them. Something that is sinful or hurtful does not necessarily become a crime, if it does not violate any provisions of the laws enacted by Congress. Child pornography is prohibited in the United States, under the Child Pornography Prevention Act of 1996. Nonetheless, the prosecution must take the necessary procedure to ensure that the case proceeds from the initial stages to trial. Technical errors in the initial stages could see the case thrown out by a jury.
Under the federal law, nudity is considered as child pornography, since it’s a visual depiction of their private parts (Mathew, 2019). Reception or distribution of child pornography is an offense under federal law (Mathew, 2019).
