LA2003 Prosecutorial Roles Answer

As the prosecutor in the case of the Smith Family Shooting, I would charge Johnny with attempted murder. This is as a result of Johnny attempting to shoot his father Mr. Smith. Johnny is 19 years old, hence under the law, he is an adult. With the history of prior arrest for assault and a history of threatening his father with a knife, this provides a criminal intent, mens rea in this case. Mens rea is also supported by the fact that Johnny owns an unregistered gun. Under California gun laws, Johnny was not supposed to own a gun, considering he had an arrest record (Lippman, 2018). In this case, Johnny purposely and knowingly shot his father, with the intention of killing him, providing a strong criminal act, actus reus to prosecute this case
